1) This Release and Waiver of Liability executed by “Volunteer” releases Friends of Buford Park & Mt. Pisgah (“Friends”), a nonprofit corporation organized and existing under the laws of Oregon and each of its directors, officers, employees, and agents, and Lane County, a political subdivision of the State of Oregon (“County”).
2) I desire to provide volunteer services for Friends and engage in activities related to serving as a volunteer. I understand the scope of my relationship with Friends and the County is limited to a volunteer position and that no compensation is expected in return for services provided by me; that Friends and the County will not provide any benefits traditionally associated with employment and that I am responsible for my own insurance coverage in the event of personal injury or illness as a result of my services.
3) Waiver and Release. I hereby agree for myself and for my heirs, relatives, representatives, estate, agents and assigns, that I will not hold liable Friends or the County, or any of the persons listed in section 5 below, and that I will waive and release any claims, demands or actions against them, for any damages to, or loss of, my property or my child’s property, or for my, or my child’s, injury or death, which results from or arises in connection with any of the activities of Friends or the County, other than that which results from gross negligence. I understand that this waiver includes a waiver of liability for acts of negligence.
a)In addition, I agree to indemnify the organization and the persons listed below for any claims made against them, on my behalf, on my child’s behalf, or otherwise, as a result of any damage to, or loss of, my property, or my child’s property, or as a result of my injury or death, or my child’s injury or death, resulting from or arising in connection with the activities of Friends, other than that which occurs as a result of the gross negligence of Friends and the County or the persons listed below.
4) Assumption of Risk. I am freely volunteering to participate in the activities offered by Friends and the County. I understand that there are dangers involved in the activities I will be participating in, including, but not limited to: dangers associated with travel, sharp objects, exposure to illness, heavy equipment, environmental hazards, etc. I understand that I am entirely responsible for deciding whether I participate in any activities with Friends and the County, and for deciding what activities in which I can safely participate.
5) Persons Covered. The persons and organizations covered by this agreement include:
a) Friends and its directors, officers, members, staff, employees, volunteers, agents and representatives, and any others who participate in the activities of Friends, or who volunteer for, or perform work for, Friends.
b) Lane County, and its elected officials, directors, employees, volunteers, agents, or representatives.
6) Photographic Release. I grant and convey to Friends and Lane County all right, title, interests in any and all photographs, images, video, or audio recordings of me, or my child, or my likeness or my child’s likeness or voice made by Friends in connection with my providing volunteer services to Friends.
7) By entering my name and information below, I signify that I have read, and I understand this Liability Waiver, and I am signing it voluntarily.
